Terms of Service

These Terms of Service ("Terms") govern access to and use of the Recov missed-call recovery service (the "Service"), operated by Recov ("Recov," "we," "us," or "our"). By signing up for or using the Service, a business ("Client," "you") agrees to these Terms.

1. The Service

Recov provides automated detection of missed, unanswered, or forwarded calls to a Client's designated phone number, and sends follow-up SMS text messages to callers on the Client's behalf. The Service may also include call logging, message inboxes, and optional custom voice greetings.

2. Client Responsibilities

  • You are responsible for configuring call forwarding correctly on your own phone line and for any charges your carrier applies for forwarding calls.
  • You must provide accurate business information for carrier and A2P 10DLC registration purposes, and promptly update it if it changes.
  • You are responsible for ensuring your use of the Service, including any custom messages or greetings you provide, complies with applicable law, including telemarketing and consumer-protection laws such as the Telephone Consumer Protection Act (TCPA).
  • You may not use the Service to send unsolicited marketing messages, spam, or messages to recipients who have not called your business number or otherwise consented to contact.

3. Opt-Out Compliance

All automated messages sent through the Service will include a means for the recipient to opt out (e.g. replying STOP). You agree not to attempt to circumvent or disable this functionality.

4. Fees and Billing

Use of the Service is billed according to the pricing plan selected at signup. Fees are billed in advance on a recurring basis unless otherwise stated. Recov may change pricing with advance notice. Failure to pay may result in suspension or termination of the Service.

5. Service Availability

We aim to keep the Service available and reliable but do not guarantee uninterrupted operation. The Service depends on third-party telecommunications carriers and infrastructure providers, and outages or delays on their end may affect call forwarding, messaging, or logging.

6. Termination

Either party may terminate use of the Service at any time. Recov may suspend or terminate access immediately if a Client violates these Terms, applicable law, or carrier messaging policies.

7. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the fullest extent permitted by law, Recov will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost business, arising from use of or inability to use the Service.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.
